General Policy Terms

General Policy Terms

These General Policy Terms (“General Terms” or “GPT”) establish the shared definitions, interpretation rules and legal provisions that apply across the policies and notices published in the Compuverse Policy Center (collectively, the “Policies”).

Each Sub-Policy that incorporates these General Terms does so by reference. These General Terms apply to that Sub-Policy as if fully set forth within it.

GPT-1.1 Policy Center

GPT-1.5 Accessibility & Accommodations

GPT-16.0 Disputes

Compuverse places a high priority on resolving disputes through direct communication, reconciliation and good-faith negotiation.

Our approach is informed by Biblical principles, including 1 Corinthians 6:1–8, which encourages believers to resolve disputes without unnecessary litigation.

These principles guide our preferred approach to conflict resolution without requiring Clients to affirm any religious belief or limiting rights that cannot lawfully be waived.

Dispute Resolution Order

GPT-16.1 Negotiation Conference

Before initiating formal proceedings, the parties will attempt to resolve the Dispute through a good-faith Negotiation Conference.

Each party should provide a representative with authority to resolve the matter.

The Conference will be scheduled within 10 Business Days after written notice unless the parties agree otherwise.

GPT-16.2 Mediation Session

If negotiation does not resolve the Dispute, either party may request mediation.

The parties will select a neutral mediator in good faith and attempt to conduct mediation within 30 days after the request.

Mediator fees will be shared equally unless otherwise agreed or required by law.

GPT-16.3 Arbitration Hearing

If mediation does not resolve the Dispute, Claims subject to a valid arbitration agreement will be resolved through binding individual arbitration, except as provided in GPT-16.6.

Unless otherwise agreed, arbitration will be administered by a nationally recognized arbitration provider in Washington, DC or through remote proceedings.

Applicable arbitration rules, legally required disclosures and nonwaivable rights remain controlling.

GPT-16.4 Settlement Conference

The parties may request a Settlement Conference to resolve remaining disagreements before seeking permitted court involvement relating to arbitration.

Where requested, the parties will attempt to conduct the Conference within 30 days unless otherwise agreed.

GPT-16.5 Class & Representative Actions Waived

To the extent permitted by applicable law and a valid arbitration agreement, Claims subject to arbitration must be brought individually rather than as class or representative proceedings.

This provision does not waive rights that cannot lawfully be waived.

GPT-16.6 Limited Court Involvement & Exceptions

The parties prefer negotiated resolution and arbitration where enforceable.

Permitted court proceedings may include:

  1. Eligible individual small claims actions
  2. Injunctive or equitable relief concerning unauthorized system access or misuse
  3. Security Incidents and interference with protected systems
  4. Intellectual property infringement or misappropriation
  5. Fraud

Nothing restricts lawful reports to regulators, law enforcement or other authorities.

GPT-16.8 Limitation of Liability

To the fullest extent permitted by law, Compuverse and its applicable affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from general Site use or Services, except where prohibited by law or expressly provided otherwise in an applicable Service Agreement.

For Claims arising solely from use of the public Site, aggregate liability will not exceed $100 to the extent permitted by law.

For paid Services, applicable liability limits will be governed by the Service Agreement. If no separate limit is established, applicable law will determine the enforceability and extent of any limitation.

These limitations do not exclude liabilities that cannot legally be limited.

GPT-16.9 Venue for Court Proceedings

Where permitted by applicable law, court proceedings not subject to arbitration will be brought in the appropriate state or federal courts located in Washington, DC.

Mandatory jurisdictional and venue requirements remain controlling.

To the extent permitted by law, Users agree to indemnify and hold harmless the applicable Compuverse entity and its officers, directors, employees and authorized agents against third-party Claims arising from unlawful Submissions, infringement of third-party rights or intentional misuse of the Site or Services.

Additional indemnification obligations may be established in Service Agreements.

GPT-18.0 Severability & Waiver

GPT-18.1 Severability

If a provision is found unenforceable, the remaining provisions continue in effect to the extent permitted by law.
